Terms of Service.

By accessing or using LuxBidr, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our platform.

These terms constitute a legally binding agreement between you and LuxBidr, Inc. regarding your use of the website, mobile applications, and services we provide.

We may modify these terms at any time. Changes are effective when posted. Your continued use of the platform after changes constitutes acceptance of the updated terms.

You must be at least 18 years old and capable of forming a legally binding contract to use LuxBidr. By using the platform, you represent and warrant that you meet these requirements.

Jewelers must maintain a valid business license, physical showroom or retail location, and all required state and federal registrations. We verify these credentials before approving any dealer account.

LuxBidr reserves the right to refuse service, terminate accounts, or remove content at our sole discretion, particularly where we suspect fraud, misrepresentation, or violation of these terms.

Buyers may post requests for jewelry items free of charge. You are responsible for the accuracy of your request details, including specifications, budget, and desired timeline.

To unlock a jeweler's full contact information, you must pay a fully refundable $99 deposit. This deposit is returned to you if you do not complete a purchase, subject to our refund policy.

LuxBidr is a marketplace connecting buyers with jewelers. We do not own, sell, or broker jewelry directly. All transactions between buyers and jewelers are independent of LuxBidr once contact is unlocked.

Buyers agree to communicate respectfully and honestly with dealers. Harassment, false requests, or abusive behavior will result in account suspension.

Jewelers may respond to buyer requests and create a profile on the platform. You are responsible for the accuracy of all inventory listings, pricing, and business information you provide.

All offers made through LuxBidr must be genuine and binding. Bait-and-switch tactics, phantom inventory, or intentionally misleading pricing are strictly prohibited and will result in permanent removal.

Jewelers must respond to buyer inquiries in a timely and professional manner. Unresponsive or unprofessional behavior negatively affects your platform rating and may lead to suspension.

Subscription fees for jeweler memberships are billed in advance and are non-refundable except where required by law or at LuxBidr's discretion.

The $99 buyer deposit is processed through our secure payment partner. It is fully refundable within 14 days if no purchase is completed, or sooner if the item was materially misdescribed or the dealer is unresponsive.

LuxBidr charges jewelers a monthly or annual membership fee based on their selected plan. Fees are non-refundable once the billing period has begun, except where we fail to deliver the agreed service level.

We are not responsible for payments made directly between buyers and jewelers outside the platform. Any such arrangements are at the sole risk of the parties involved.

Users may not post false, fraudulent, or misleading requests or offers. This includes phantom inventory, significantly misdescribed items, or requests with no genuine intent to purchase.

You may not use LuxBidr to conduct illegal activity, including money laundering, sale of counterfeit goods, or trade in stolen property.

Harassment, hate speech, threats, or abusive language toward other users or LuxBidr staff will result in immediate account termination and possible legal action.

Users may not attempt to circumvent LuxBidr's fee structure by soliciting or completing transactions outside the platform after initial contact was made through LuxBidr.

Automated scraping, data mining, bot usage, or any attempt to extract user data from the platform without authorization is strictly prohibited.

LuxBidr provides the platform on an 'as is' and 'as available' basis. We do not guarantee that the platform will be uninterrupted, error-free, or secure at all times.

We do not verify the authenticity, quality, or value of individual jewelry items listed or offered by jewelers. Buyers are strongly encouraged to conduct independent due diligence, including third-party appraisals, before completing a purchase.

LuxBidr is not a party to any transaction between buyers and jewelers. We do not guarantee that any offer will be accepted, that any item will be as described, or that any transaction will be completed successfully.

To the maximum extent permitted by law, LuxBidr and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform.

Our total liability to you for any claim arising from these terms or your use of LuxBidr shall not exceed the total amount you have paid to LuxBidr in the twelve months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you.

You agree to indemnify and hold harmless LuxBidr, its affiliates, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses arising out of your use of the platform, your violation of these terms, or your violation of any rights of another party.

This indemnification obligation survives the termination of your account and these terms.

LuxBidr may suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these terms, is harmful to other users, or is illegal.

You may terminate your account at any time by contacting support. Upon termination, your right to use the platform ceases immediately. Certain provisions of these terms will survive termination.

All fees paid prior to termination are non-refundable unless otherwise stated.

These Terms of Service and any dispute arising from them shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law principles.

Any disputes not resolved through negotiation or mediation shall be brought exclusively in the state or federal courts located in New York County, New York.

We reserve the right to modify these terms at any time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before they take effect.

Your continued use of LuxBidr after changes become effective constitutes acceptance of the revised terms. If you do not agree to the changes, you must stop using the platform.
